A Software Company

1 Acceptance of Terms

By downloading, installing, or using Viscriptix ("the Software"), you agree to these Terms of Service. If you do not agree, do not use the Software.

2 License

  • Upon purchase, you receive a non-exclusive license to use Viscriptix on one (1) computer
  • The license is personal, non-transferable, and tied to your device
  • A free trial is available to evaluate the Software before purchase
  • To transfer your license to a new device, you must deactivate your license on the other machine first

3 Intellectual Property

  • The Software, including its code, design, documentation, and all associated materials, is the intellectual property of A Software Company and is protected by applicable copyright and trademark law
  • You may not copy, reproduce, modify, decompile, disassemble, reverse engineer, or create derivative works of the Software
  • You may not redistribute, sublicense, resell, rent, lease, or loan the Software or any portion thereof

4 Data Ownership & AI Training

  • You retain full ownership of all content you process with the Software, including your media files, generated metadata, titles, keywords, and descriptions
  • A Software Company does not claim any ownership or license over your content
  • When you use third-party AI services, data is sent directly from your device to the provider; A Software Company does not intercept, store, or use this data

5 Purchases & Refunds

  • Viscriptix is available as a one-time purchase through our authorized merchant of record
  • A free trial is provided so you can evaluate the Software before buying
  • Refunds may be issued at the sole discretion of A Software Company

6 Activation & Account Security

  • License activation requires an internet connection
  • You are responsible for maintaining the security and confidentiality of your license key
  • A Software Company reserves the right to disable licenses obtained fraudulently or in violation of these terms

7 Third-Party Services

  • The Software can optionally integrate with third-party AI services for content generation, including OpenAI, Google Gemini, and Ollama
  • All third-party integrations are optional and selected by you
  • You are responsible for providing your own API credentials and for any costs incurred through those services
  • You must comply with the terms of service of any third-party provider you use

8 AI-Generated Content

  • All metadata and descriptions generated by the Software are AI-assisted suggestions
  • You are responsible for reviewing and verifying all generated content before use or submission to stock agencies
  • A Software Company makes no warranty regarding the accuracy, completeness, or suitability of generated content

9 Acceptable Use

You agree to use the Software only for lawful purposes and in compliance with all applicable laws and regulations. You may not use the Software in any manner that infringes on the rights of others.

Violation of this policy may result in immediate revocation of your license without refund. A Software Company reserves the right to cooperate with law enforcement authorities where required by law.

10 Termination

  • A Software Company may terminate or suspend your license at any time, without prior notice, if you breach these Terms of Service
  • Upon termination, you must cease all use of the Software and destroy any copies in your possession
  • Sections relating to intellectual property, limitation of liability, and governing law survive termination

11 Disclaimer of Warranties

The software is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. A Software Company does not warrant that the software will meet your requirements, operate without interruption, or be error-free.

12 Limitation of Liability

In no event shall A Software Company be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, loss of business, or loss or corruption of data, arising from your use of the software, regardless of the theory of liability.

13 Changes to Terms

A Software Company may update these terms at any time. Continued use of the Software after changes constitutes acceptance. Current terms are always available at this page.

14 Governing Law

These terms are governed by the laws of the State of Washington, United States of America. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in the State of Washington.
